By accessing or using bsynqed, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.
These terms apply to all users of bsynqed, including property owners, managers, staff, and guests using our booking engine.
Description of Service
bsynqed provides a Property Management System (PMS) and Channel Manager platform designed for independent properties, including:
- Property and inventory management (rooms, beds, units)
- Booking management and calendar
- Channel Manager for OTA integrations (Booking.com, HostelWorld, etc.)
- Point of Sale (POS) for restaurants and shops
- Tours and Events management
- Public booking engine for guest reservations
- Payment processing (Stripe, PayPal)
- Housekeeping and front desk tools
- Reporting and analytics
Account Registration
To use bsynqed, you must:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Be at least 18 years old or have parental consent
You are responsible for all activities that occur under your account. Notify us immediately if you suspect unauthorized access.
Payment Terms
Transparent Pricing: We believe in transparent, upfront pricing with no hidden fees.
- Free tier available with core features
- Paid plans billed monthly or annually
- All prices displayed in EUR unless otherwise stated
- Payment processed securely through Stripe or PayPal
- No setup fees, cancellation fees, or hidden charges
- You can upgrade, downgrade, or cancel at any time
- Refunds handled on a case-by-case basis for annual plans
If payment fails, we may suspend your account until payment is resolved. We'll notify you before suspension.
Service Availability
We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We'll notify you of planned maintenance when possible.
We are not liable for any losses resulting from service interruptions, though we'll work to restore service promptly.
Offline Functionality
Some features of our platform may work offline with limited functionality. When using offline features:
- Limited data may be stored on your device to enable offline access
- Only minimal, encrypted data is stored locally (see our Privacy Policy for details)
- Certain features require an internet connection (payments, message sending, booking modifications)
- Data stored offline is automatically synced when you reconnect to the internet
You are responsible for maintaining the security of your device. We are not liable for any loss or unauthorized access to data stored on your device, though we implement strong encryption and security measures as described in our Privacy Policy.
User Obligations
You agree to:
- Use the service only for lawful purposes
- Not attempt to gain unauthorized access to our systems
- Not interfere with or disrupt the service
- Not use the service to transmit harmful code or malware
- Comply with all applicable laws and regulations
- Respect intellectual property rights
- Not use the service to compete with bsynqed or reverse engineer our platform
Intellectual Property
The bsynqed platform, including software, design, logos, and content, is owned by bsynqed and protected by intellectual property laws. You receive a limited, non-exclusive license to use the service for your property operations.
Your Data: You retain all rights to your property data, bookings, and content. We don't claim ownership of your data.
Limitation of Liability
To the maximum extent permitted by law:
- bsynqed is provided “as is” without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid in the 12 months preceding the claim
- We are not responsible for losses due to OTA integration issues, payment processor problems, or third-party services
- You are responsible for backing up your data (though we provide export capabilities)
Indemnification
You agree to indemnify and hold bsynqed harmless from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any rights.
Termination
Either party may terminate this agreement:
- By You: Cancel your account at any time through your settings
- By Us: We may suspend or terminate accounts that violate these terms, engage in fraud, or fail to pay
Upon termination, you can export your data for 90 days. After that, data is deleted unless legal requirements mandate retention.
Changes to Terms
We may update these Terms of Service from time to time. Significant changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance of the new terms.
Governing Law
These terms are governed by the laws of the United Kingdom. Any disputes will be resolved through arbitration or in the courts of London, United Kingdom.
